1. Introduction

Welcome to Enchanted by AGG (“we,” “our,” or “us”).
These Terms and Conditions (“Terms”) govern your use of our website www.enchantedbyagg.com, social media pages, and all related services including photography, videography, editing, and gallery delivery (collectively, the “Service”).

By booking a session, making a payment, or using our website, you agree to these Terms.

2. Governing Law

These Terms are governed by and interpreted under the laws of the State of Texas, United States.
Any disputes shall be handled in the courts of Harris County Texas.

3. Legal Requirements

You must be 18 years or older to book services.
By booking or using our website, you confirm that the information you provide is accurate and that you have the legal authority to enter into a service agreement.

4. Content Ownership & Copyright

All images, videos, and creative works produced by Enchanted by AGG remain the intellectual property of the studio unless otherwise stated in writing.

Clients receive personal use rights, which include:

  • Printing and sharing images or videos for personal use or social media (with credit/tagging appreciated).

Clients may not:

  • Alter, sell, or use our work for commercial purposes without written consent.

  • Apply filters or edits that misrepresent the original work without permission.

We reserve the right to use images and videos for portfolio display, website, and marketing purposes unless the client provides a written request for privacy before the session.

5. Booking & Payments

  • A non-refundable retainer is required to secure your date.

  • Remaining balances must be paid by the due date listed on your invoice.

  • Sessions are not confirmed until the retainer is received.

  • Late or missed payments may delay delivery or cancel the session.

6. Cancellations & Rescheduling

  • Retainers are non-refundable, but may be applied to a new date if rescheduled, based on availability.

  • Weather or emergency reschedules are handled at the photographer’s discretion.

  • If we must cancel due to unforeseen circumstances, all payments will be refunded.

7. Delivery of Photos & Videos

  • Final galleries or video links will be delivered within the timeframe specified in your agreement.

  • Files are delivered digitally through a secure gallery or link.

  • Clients are responsible for downloading and safely backing up all files.

  • File storage after delivery is not guaranteed.

8. Client Privacy & Data Protection

Your privacy matters to us.
We collect only the information necessary to process bookings and deliver services (such as name, email, and event details).
Your data will never be sold or shared with third parties.

All digital files are stored securely and may be backed up temporarily for quality assurance.
Clients may request deletion of personal data or files via email at enchantedbyagg@gmail.com after delivery.

9. Social Media Usage & Consent

We love showcasing our work and celebrating our clients!
By booking, you grant Enchanted by AGG permission to use your photos and videos for portfolio, website, and social media purposes.

If you prefer to keep your images or videos private, please notify us in writing before your session, and we will fully respect your privacy.

10. Rules of Conduct (Website & Communication)

When using our website or communicating with us, you agree not to:

  • Post or share unlawful, harmful, or defamatory content.

  • Copy or redistribute our portfolio work without permission.

  • Use our content for misleading or competitive purposes.​

11. Dispute Resolution

We aim to resolve any concerns quickly and professionally.

If unresolved, disputes will be handled under Texas law.

12. Limitation of Liability

Enchanted by AGG is not responsible for:

  • Events beyond our control (equipment failure, illness, weather, etc.).

  • Data loss or damage once files are delivered.

Our total liability for any claim shall not exceed the amount paid for the service.

We may update these Terms periodically.
Updates will be posted on this page with the new effective date.
Continued use of our services indicates acceptance of the updated Terms.
